Pemenuhan Hak Restitusi Bagi Anak Korban Kejahatan Seksual

Abstract

Tujuan penelitian menganalisis pemenuhan hak restitusi bagi anak korban kejahatan seksual di Kota Makassar; (2) untuk memahami dan menganalisis faktor yang memengaruhi penegakan hukum dan korban dalam pemenuhan hak restitusi bagi anak korban kejahatan seksual di Kota Makassar. Penelitian ini menggunakan metode hukum empiris. Hasil penelitian menunjukkan bahwa implementasi pemenuhan hak restitusi bagi anak korban kejahatan seksual di Kota Makassar tidak terpenuhi, seperti yang ditunjukkan dari 11 kasus kejahatan seksual yang diputus di pengadilan hanya ada satu kasus yang dimana korban mengajukan permohonan restitusi namun korban tidak memperoleh restitusi dari pelaku. Adapun faktor penegak hukum dan korban memiliki pengaruh yang signifikan terhadap terpenuhi atau tidaknya restitusi karena pihak penegak hukum tidak memberikan informasi kepada korban atau keluarganya mengenai hak mereka untuk melakukan hal tersebut, sehingga restitusi tidak mungkin dilaksanakan. Korban pun memilih untuk mengajukan permohonan restitusi hanya dikabulkan dan tidak selalu diterima oleh korban.

The research objective is to analyze the fulfilment of the right to restitution for child victims of sexual crimes in Makassar City; (2) to understand and analyze the factors that influence law enforcement and victims in fulfilling the right to restitution for child victims of sexual crimes in Makassar City. This research uses empirical legal methods. The research results show that the implementation of the right to restitution for child victims of sexual crimes in Makassar City is not fulfilled, as shown by 11 cases of sexual crimes that were decided in court, there was only one case where the victim submitted a request for restitution but the victim did not receive restitution from the perpetrator. Law enforcement and victim factors significantly influence whether or not restitution is fulfilled because law enforcement does not provide information to victims or their families regarding their rights to do so, so restitution is impossible to carry out. The victim also chooses to submit a request for restitution which is only granted and not always accepted by the victim.
